These Terms of Service ("Terms") govern your use of our computerized maintenance management system (CMMS) ("Service"). By accessing or using our Service, you agree to comply with and be bound by these Terms.

2. Service Description

Our CMMS is designed to help industries maintain their fixed assets efficiently. The Service includes various features and tools to manage maintenance tasks, schedules, and records.

3. User Accounts

**Account Creation**: Users must create an account to access our Service. By creating an account, you agree to our Privacy Policy.
**Account Types**: We offer three types of accounts: Basic, Advanced, and Professional.
**Account Cancellation**: Users can request account cancellation and data deletion here.

4. Payment and Billing

**Payments**: Payments are handled through our secure payment gateway.
**Refund Policy**: Please refer to our Refund Policy for details.

5. User Conduct

Users must adhere to the following guidelines:
Add data with rates that are "within reason," as defined by us.
Do not violate the law, adversely impact other customers' ability to use the Service, access other customers’ data, spam, create offensive content, cause intellectual property infringement, or endanger the security of the system.

6. Privacy and Data Security

We handle user data and privacy in accordance with our Privacy Policy.

7. Intellectual Property

**User-Generated Content**: User-generated content is the property and for the sole use of the user organization. It will be made available as raw system export files in case of account cancellations on request.

8. Dispute Resolution

**Handling Disputes**: We handle disputes or complaints by receiving requests via email, analyzing them, and informing the client of our decision via email.

9. Modifications to the Service

**Special notes:**: For cancelled product versions (v1.6 - Dec 2022 and earlier) We will automatically pause scheduled jobs in organization accounts with no user logins for over 6 months. This is to avoid accumulation of data on abandoned accounts. We will cancel subscriptions for organization accounts that have had no user logins for over 8 months. For those cases, we will place a warning on the login page 3 months prior to the subscription expiry date. We will then remove the account 1 week after the expiry date. Organization accounts with no logins for over 6 months on cancelled product versions (v1.6 - Dec 2022 and earlier) that have the intention to renew their account, must upgrade to the current version of comma CMMS (data transfer to the new account may or may not be possible).
**Service Changes**: We will not change or discontinue parts of the Service during the contracted period.
**Notification**: Users will be notified of significant changes via email.
